Member of The Nation Municipality's Committee of Adjustment

Summary

The powers of the Committee of Adjustment are set out in Section 45 of the Planning Act (R.S.O. 1990, c. P.13). Under this section, a property owner may apply to the Committee of Adjustment for relief from certain zoning by-law requirements passed under Sections 34 or 38 of the Act. 

The Committee has the authority to approve a Minor Variance, which is a small change to the zoning by-law, if it believes the change is reasonable and appropriate for the development or use of the land, building, or structure. However, the Committee can only approve the variance if it is satisfied that the general intent and purpose of the zoning by-law and the Official Plan are maintained.
