Zoning By-Law Amendments

Before submitting an application, a consultation with the Planning Department is required. 
The purpose of the consultation is to:

• Confirm whether a Zoning By-law Amendment is necessary.
• Provide preliminary comments and feedback on the proposed amendment.
• Tailor the submission requirements based on the context of the proposal.
• The municipality will provide appropriate documentation for the Zoning By-Law Amendment application.

Applicants must submit a completed application to the Municipality and pay the application fees as established in the Fees & Charges By-Law. The application will be reviewed internally; comments may be provided to the applicant.

Once the application has been completed and reviewed, a public meeting will be scheduled. A public notice sign must be posted on the subject property at least 20 days prior to the meeting. The Municipality will send a Public Planning Meeting Notice to residents/owners living within 120 meters of the subject property. The notice will also be posted on the Municipality’s website.

The Planning Department will prepare a report outlining the proposal for Council. A Public Zoning Meeting will then be held, where Council will review all submitted documentation, consider staff recommendations, and make a decision on the application. 

The amendment may be Approved or Refused by Council. The Nation Municipality will issue a Notice of Decision within 15 days of the Council’s decision. 

From the date the notice is issued, there is a 20-day appeal period during which eligible parties may file an appeal with the Ontario Land Tribunal (OLT) If no appeal is received within that time, the amendment comes into effect.
